What does the law say?
Florida law dictates that driving under the influence is defined as having a blood alcohol level of .08 or higher. This can be proven in a variety of ways by law enforcement but the punishment remains the same regardless for violators of the law.
Upon the first conviction of a DUI, the person at fault can be granted a fine anywhere from $500 to $1000. They are also given a mandatory fifty hours of community service and, depending on the situation, can be given jail time.
