The case was tried to a jury, which returned a verdict of $27.56 million. Car Accident, Vehicle Incursion into a Storefront, Settlement

An SUV accelerated across a walkway and through the wall of a Miami dental office waiting room.

The client was sitting in the lobby of a dental office at a shopping center on Coral Way in Miami when a driver hit the accelerator instead of the brake and drove through the building, pinning her beneath the vehicle. Because the driver carried only $100,000 in coverage, Payer Law built the case primarily as a premises liability claim against the property owner for failing to install bollards in front of the dental office, retaining an accident reconstructionist and a national storefront safety expert and citing Miami-Dade County Ordinance No. 12-47. They filed suit in Miami-Dade County Circuit Court, deposed the owners, tenants and maintenance contractor, and resolved the case just before trial for a total recovery of $875,000, which included $100,000 for her husband’s loss of consortium claim.

Car Accident, Failure to Yield, Cervical Fractures, Mediated Settlement

A 79-year-old driver with a green light was struck by a motorist turning left across his path.

The client, a 79-year-old man with the right of way, was struck at SW 109th Avenue and West Flagler Street in Miami-Dade County by a driver making a left turn. He sustained a C2 bilateral pedicle fracture, C3 and T1 endplate fractures, an epidural hematoma and a right vertebral artery intimal tear, and was hospitalized for three days. The at-fault driver’s insurer denied liability outright and made no pre-suit offer. Payer Law filed suit and the case resolved at court-ordered mediation for $62,500.
