DUI accidents can be traumatic and devastating for victims whose lives are often altered forever. You don’t have to go through this unimaginable time alone. Our Miami DUI accident attorneys are here for you every step of the way.

Rear-End Crashes

Rear-end crashes can cause a surprising amount of vehicle damage and significant injuries. Also, even though they look straightforward, identifying who was truly at fault for the crash is often challenging. Our Miami rear-end crash lawyers can help you identify the responsible party and pursue the compensation you deserve.

Rollovers

Rollover accidents often cause life-changing injuries to victims, significantly impacting their physical, emotional, and financial well-being. When this happens, you need a lawyer who is prepared to fight for you to receive much-deserved justice. Intersection Crashes

Intersection crashes frequently result in complex cases in which fault is contested. If you were injured in an intersection crash, our Miami intersection crash attorneys can help you pursue all available damages.

Pedestrian accidents

Pedestrian Accidents are another type of especially dangerous accident, particularly if the vehicle involved was traveling at a high speed. Because of their sheer weight and size, modern trucks can cause unimaginable damage to other vehicles and their occupants in crashes, especially at high speeds. Our Miami truck accident attorneys can help you recover the compensation you need to move forward.

Uber Accidents

If you were injured while riding in an Uber or by an Uber driver, it may be challenging to identify who was truly at fault for the crash and determine the applicable insurance coverage. Our Miami Uber accident lawyers can help you identify all liable parties and pursue the compensation you deserve.

Lyft Accidents

Like Uber accidents, accidents involving Lyft drivers can also be challenging. Multiple parties may share fault, including the rideshare company itself, and several insurance policies might come into play. Our Miami Lyft accident lawyers can help you identify the parties responsible for your injuries and pursue the compensation you deserve.

Who Could be Liable For My Injuries After a Car Accident?

Florida is a no-fault state for car accidents, meaning you must first pursue a claim under your own insurance policy after an accident, regardless of who’s at fault for the wreck. Your mandatory Personal Injury Protection coverage, or PIP, covers medical expenses, lost wages, and property damage. However, if your injuries are severe, you can seek additional compensation directly from liable parties through a personal injury claim.

Any party that causes or contributes to your collision could be liable for your injuries. Parties that are often held liable for car accident injuries include the following:

  • Motorists
  • Truck drivers
  • Passengers
  • Pedestrians
  • Bicyclists
  • Trucking companies
  • Motorcyclists
  • Transit companies
  • Vehicle manufacturers
  • Government entities

It is possible that multiple parties are responsible for your injuries and could be held liable in a personal injury claim. An experienced Miami personal injury attorney can thoroughly investigate to determine who is liable for your injuries and help you pursue all available damages.

Miami Car Accident Statistics

Unfortunately, car accidents occur far too often in Miami and the surrounding areas in Florida. In 2024 alone, there were nearly 60,000 crashes in Miami-Dade County. In those crashes, 288 people died, while more than 29,000 people were injured. About 19,000 collisions were hit-and-runs, 1,395 involved motorcycles, 999 involved bicycles, and 1862 involved pedestrians. Auto accidents peaked in Miami-Dade County in March 2024, declined over the summer, and hit a low point in November.

While the 2024 crash numbers are high, there were fewer auto accidents in Miami-Dade County in 2024 than in 2023 and 2022. The percentage of Miami-Dade crashes that resulted in a fatality also declined between 2023 and 2024. In 2023, Miami-Dade saw nearly 64,000 total car crashes that caused 359 deaths and close to 30,000 injuries. Miami Car Accident Lawsuit FAQs

If you’ve been involved in a car accident in Miami, you likely have countless questions about what to do next. See our frequently asked questions below to learn more about your legal rights and options after a crash.

A Miami car accident lawyer can protect your rights and help you get fair compensation, whether your injuries seem minor or severe. They handle the legal work, push back against unfair blame, and allow you to focus on recovery.

The amount of money you can get from a car accident case will depend on the specifics of your claim and various critical factors, including the following:

  • The nature and severity of your injury
  • The strength of available evidence
  • The medical treatment required
  • The length of time it takes to reach maximum medical improvement
  • Insurance policy coverage
  • Time missed from work
  • Vehicle repair or replacement estimates
  • Your ability to return to work
  • How the injury impacts your quality of life

A skilled Miami car accident attorney can help you assess what your crash case is worth and fight to ensure that you don’t settle for less.

In Miami, you have two years from the date of the accident to file a lawsuit. If you miss the deadline, you lose the chance to recover any compensation—no matter how strong your case is. A lawyer can make sure you meet all deadlines.

You may be entitled to compensation for both economic and non-economic damages. This includes medical bills, lost income, property damage, out-of-pocket expenses, pain and suffering, emotional distress, and reduced quality of life. In rare cases, punitive damages may also apply. A lawyer can help you calculate and pursue the full amount you’re owed.

At Payer Law, we work on a contingency fee basis, so you don’t pay anything upfront. We only get paid if we win your case, and our fee comes from a pre-agreed percentage of your settlement or verdict. If there’s no recovery, you owe us nothing. Contact us for a free consultation to learn more.

Florida is a no-fault state for car accidents, meaning you can recover compensation after a crash regardless of who was at fault. Each driver must carry a minimum of $10,000 in personal injury protection insurance, or PIP, and a minimum of $10,000 in property damage liability insurance. This no-fault system requires you to file a claim with your insurer after a wreck.

If your injuries are serious enough to pursue compensation outside the no-fault system, you can still recover damages even if you were partially at fault. For injuries to qualify as serious, one of the following must occur:

  • Significant and permanent loss of a bodily function
  • You suffered a permanent injury
  • Significant and permanent scarring or disfigurement
  • Death

Florida is a modified comparative negligence state. You can still receive compensation if you share less than 51 percent of the blame for the crash. However, the amount you receive will be reduced in proportion to your share of the fault. For example, if your damages are valued at $100,000 and were 40 percent at fault, you can only recover $60,000 in compensation.

Comparative fault can significantly impact your personal injury claim and the compensation you’re able to receive. You can lose the ability to recover damages entirely if you are more than 50 percent to blame for the collision. A skilled car accident lawyer can help you combat unfair allegations of comparative fault and help you pursue the full compensation you’re entitled to.

Most car accident cases in Miami, Florida, are settled before going to trial. However, your case may go to trial if your injuries are serious and the insurance company or at-fault party refuses to offer a fair settlement.

While most cases are resolved through settlements, hiring a skilled Miami trial attorney is crucial to help you navigate this process. They can develop an effective strategy tailored to your needs and prepare your case for trial. A willingness to go to trial and the process of conducting pre-trial discovery can also help strengthen your evidence, improve settlement negotiations, and lead to a more just resolution.

Car accidents in Miami, Florida, can be overwhelming for everyone involved. Understanding what to do after a wreck can help you be better prepared for the following process. After an accident in Miami, take these steps:

  • Alert law enforcement and get to a safe location
  • Seek immediate medical attention
  • Exchange information with the other driver
  • Gather witness statements and contact information
  • Document what led to the collision, the weather and road conditions, and what happened after the crash
  • Take pictures and videos of the accident scene, vehicle damage, and visible injuries
  • Notify your insurance company of the collision
  • Consult a Miami car accident attorney

DO NOT admit fault at the accident scene or when speaking with the insurance company. Anything you say can impact a subsequent personal injury claim. Before agreeing to provide a statement to the insurance company, consult a Miami personal injury attorney.

Car accident victims experience various types of injuries, ranging from minor to life-altering and even fatal. Common types of car accident injuries include the following:

  • Traumatic brain injuries
  • Broken bones
  • Crushing injuries
  • Airbag injuries
  • Eye injuries
  • Burns
  • Whiplash
  • Lacerations
  • Soft tissue damage
  • Nerve damage
  • Spinal cord injuries
  • Concussions
  • Back injuries
  • Neck injuries
  • Sprains and strains
  • Internal bleeding
  • Road rash
  • Paralysis
  • Amputation

Seek the medical attention you need immediately after a collision. Doing so can speed your recovery, establish a valuable record, and protect a subsequent personal injury claim.
