$360,000

Workers’ Compensation

SETTLEMENT

A welder was steadying one end of a large metal drainage pipe for the Miami I-395 bridge project while a forklift lowered it onto a sawhorse. The operator lowered the pipe too quickly, and the sawhorse tipped onto the welder’s leg, causing multiple fractures to his right tibia and fibula. He needed surgery to implant plates and screws, and a second surgery to remove the hardware once the bones healed. The statutory employer initially denied the claim, so we filed a civil lawsuit against his employer. After litigation, the correct workers’ compensation carrier came forward and accepted the case. It paid more than $50,000 in past lost wages and all of his outstanding medical bills, in addition to the $210,000 settlement.

We spent more than 200 hours taking eight depositions of subcontractors and witnesses to establish the employer.
