A landscaper’s helper in Key Biscayne was electrocuted through a pole saw while cutting a palm frond that was touching an overhead power transmission line.
The client lost his left eye, suffered third degree burns across 40 percent of his body, spent months in the Ryder Trauma Burn Unit on life support and underwent more than ten surgeries. His employer carried no workers’ compensation insurance. Payer Law recovered the homeowner’s policy before suit, then sued the power company for negligent vegetation management, using the utility’s own internal palm log and trouble ticket records to establish that the hazard was foreseeable. The case resolved shortly after mediation, five years into the litigation.

Workplace Injury, Miami
A Miami worker loading a package vehicle fell backwards into it from a height of about three feet and did not realize how badly he was hurt until the following day.

Vehicle Incursion into a Storefront, Miami Premises Liability
A client sitting in a dentist’s office waiting room at a shopping center on Coral Way in Miami was struck when an SUV parked head in to the building drove through the storefront.
She spent nearly a week in a coma, close to a month in hospital, several weeks in a rehabilitation facility and two years in physical therapy. Payer Law filed suit in Miami-Dade County Circuit Court and argued that the property owner had installed protective bollards in front of some tenants and not others, and that Miami-Dade County Ordinance No. 12-47 required them. The case resolved just before trial and included $100,000 for her husband’s loss of consortium.

A customer at a major retail store in Miami broke a bone in her foot when a coffee grinder tray fell onto it.
She endured two months of constant pain before seeking legal help, and the store’s opening position included an offer of $250 attached to a document that would have released the company from liability. Payer Law rejected it and tried the case. The jury returned a verdict of $389,000, and the client has since referred others to the firm.

Car Accident, Failure to Yield, Miami-Dade
A 79 year old client with a green light and the right of way was struck by a driver turning left at SW 109th Avenue and West Flagler Street.
His vehicle spun into a fence. He sustained a C2 bilateral pedicle fracture, C3 and T1 endplate fractures, an epidural hematoma and a right vertebral artery intimal tear, and was hospitalized for three days. The at fault driver’s insurer denied liability outright and made no offer before suit. As James D. Payer put it, just because an insurance company denies a claim does not mean the case is over. The matter settled at court ordered mediation.
