If you’re injured in a personal injury accident in Miami or anywhere in Florida, you have two years from the date of the accident to file a lawsuit. This is known as the statute of limitations. It used to be four years, but the law changed recently. If the injured person is a minor (under 18), that two-year period doesn’t start until they turn 18—so in most cases, they have until their 20th birthday to file a claim. For adults, though, once the accident happens, that two-year clock starts ticking right away. While two years might seem like a long time, it can pass quickly once you begin medical treatment and the legal process starts moving. That’s why it’s so important to hire an attorney as soon as possible. If you miss the two-year deadline, you lose your right to take legal action and recover compensation—even if the other person was clearly at fault. At Payer Law, we make sure that never happens. Protecting your right to file and getting your case started on time is one of the most important parts of what we do.
