Compensation Options for Pedestrians and Cyclists

shutterstock_1190765305

Orlando is ranked the most dangerous city for pedestrians in the country, according to a study entitled “Dangerous by Design,” according to Orlando Weekly. This is not the first time Orlando has been awarded this title, unfortunately. Orlando ranked sixth among all cities in the country when it came to pedestrian deaths per capita between 2008 and 2017, and scored the highest “Pedestrian Danger Index” of all cities in the country, which is a ranking based on “how deadly it is for people to walk in a state or metropolitan area. . .” The problem stems from the fact that Orlando is designed for cars, not pedestrians or cyclists, and these vulnerable road users suffer the grave consequences of catering to drivers. If you got hit as a pedestrian or cyclist, you do have options for compensation by working with an experienced pedestrian or cyclist injury attorney.

Personal Injury Protection (PIP) Insurance

As a cyclist or pedestrian, if you have PIP coverage, which is a requirement for all motorists, you are covered even if you were on foot or on a bike. This is because PIP insurance protects you financially when you are a driver, pedestrian, cyclist, or other road users, and it also protects occupants, such as your children, when they are riding in your vehicle, according to Florida statute 627.736. You can quickly pursue compensation for medical bills and property damage (such as damage sustained to your bike) through your PIP policy, which stands as the first line of defense should you become injured as a pedestrian or cyclist.

Personal Injury Claim Against the Other Party

Your next step is to file a claim with the at-fault party. PIP only covers a small portion of medical bills, property damage, and lost wages, and if your injuries are serious, you need to file a lawsuit (personal injury claim) with the driver who hit you or caused your injuries.

Uninsured/Underinsured Motorist Coverage

Florida has a high rate of uninsured drivers—the highest in the country, in fact. Millions of other Florida drivers have no bodily injury liability, or they only have a small amount. If this is the case, your best option is to pursue what little they do have, and then also file a claim with your own insurance company. Depending on the size of your uninsured/underinsured motorist policy, you may be able to be heavily compensated for all of your damages, including medical bills, pain and suffering, lost earning capacity, and more.
