Who is eligible for Florida Wrongful Death Damages?

Husbands, wives, parents, and children of loved ones may be eligible for damages as a result of a wrongful death in Florida. Florida law states that family members can be compensated for medical as well as funeral expenses, noneconomic claims such as losing the companionship of the deceased family member, and the emotional toll of pain and suffering. In the case of medical malpractice, children under 25 and financial dependents are eligible for compensation for the death of a parent.

Death Benefits under Florida Workers' Compensation Laws:

Florida's Workers Compensation Laws provide for certain death benefits for the surviving spouse and children of the deceased worker. Additionally, the parent or parents of a deceased worker may be entitled to recover benefits if they were financially dependent upon the deceased worker. In one recent case, lawyers at Payer Law Group successfully obtained death benefits for a dependent elderly parent suffering from Parkinson's disease who resides in Cuba when their child was killed at work in Florida.
