Unfortunately crime occurs every day in Florida. Far too often those crimes are preventable if the property owner or occupant takes very simple precautions. A property owner or occupant may be negligent for failure to have proper security personnel on their property. Additionally, liability may result from failure to properly maintain the property, physically secure the property with things like walls and fencing and even improper or inadequate lighting. We just recently recovered money from an apartment complex which left an electric gate broken for 3 months and our client was shot in the face during a home invasion. The day the shooting occurred they were renting apartments using brochures which claimed it was a “gated community”. That’s wrong and they needed to pay.
