As Florida residents and avid SCUBA divers and boaters for over 35 years the attorneys at the Payer Law Group are very familiar with boating and diving accidents and the consequences they can have. While a day on the water can be very enjoyable our own experience has shown that they can turn tragic due to the negligence of another. More than ten years ago while on a dive trip in the Florida Keys, James and Christian Payer were on a perfect dive which turned tragic when a fellow diver and close personal friend was struck and killed by a passing boat.
Boating and diving accidents occur far too frequently in Florida and are usually avoidable and commonly involve very serious injuries or even death. Boating and diving accidents often involve someone operating a boat or other water craft while under the influence of alcohol, equipment failure, negligently failing to take the proper precautions, or failure to have the proper safety equipment on board a vessel including life rafts and life vests.
Boating accidents fall into two basic and overly simplified categories. Typical local state laws of “negligence” and “reasonable care” apply to all persons operating water craft on smaller or interior state waterways, such as most rivers, canals, lakes and even ponds. On the other hand, accidents on larger bodies of water with tides (typically known as navigable waters) involve a complex array of Federal rules known as Maritime law. Maritime law includes Jones Act cases, Death on the High Seas Act cases and an entire body of case law (both State and Federal) dealing with issues such as personal injury, boat crashes, seaworthiness” and Longshore and Harborworkers claims. Cruise ships are included in this category.
